The 4 most common types of sales in the residential real estate market: 

1) Regular Sale: 

The buyer makes an offer which is accepted by the seller within 24 to 48 hours and the closing is held within 45 days. 

2) Foreclosure sale:  

The buyer makes an offer for a bank owned property and the bank continues to take offers for 2 to 3 weeks before deciding whether to accept any of the offers. If accepted, closing is held within 30 days. 

3) Un-approved price Short sale or pre-foreclosure: 

The buyer makes an offer which is accepted by the seller but which is subject to the seller’s bank approval because the selling price is less than the mortgage amount due. The asking price is arbitrarily set by the seller and has not been approved by the seller's bank. The seller continues to accept other offers for 3 to 12 months. Then 3 to 12 months after the first offer the seller's bank will look at all the offers collected. The seller's bank could then decide to reject all offers and raise the asking price. 

4) Approved price Short sale: 

After 3 months for sale on the market, the seller's bank will set the low price they are willing to accept. If offer is accepted, closing can be done in 30 days.  

First a seller has to be approved by their bank to do a short sale then several months later the seller's bank has to approve the asking price.

1)Will a buyer get a better price if they deal directly with the listing agent? 

No, most listing agreements allow the listing agent to "Double Dip" and collect the entire 6% commission with no savings to the seller or buyer thus no savings in the asking price. 

Many listing agents are friends & family of the owners and the buyer would have no one to negotiate on their behalf or to do a comparable sales analysis. The buyer could end up paying more than if they had a buyer's agent who is paid half of the 6% commision from the seller. 

Many foreclosure banks do not allow the listing agent to work with buyers. 


2) How much is the property tax? 

In Southeast Florida, the property taxes are reset to approximately 2% of the purchase price effective January 1st of the following year. 


3) Can I buy a foreclosure home with an FHA loan? 

First, an FHA approved home has to be in livable condition with no damage. Most foreclosures have some type of damage. 

Second, cash is king when selecting offers on foreclosures. The offers with the most cash will often be selected even if the offered price is lower than an offer with a low downpayment. 

Today's conventional loans require a minimum 20% downpayment.

Before you list your home for sale, take a careful look around. Are there some items you will want to take with you? There may be a dining room chandelier that has been in your family for three generations, a ceiling fan in the master bedroom, or the bookcases in the den that look built-in but are not.

Normally all fixtures are conveyed to the new owners when a house is sold. This includes anything that is attached to walls or ceilings and, in some areas, all major appliances that are installed in the house. If you have fixtures that you don't want to convey, tell your agent what you want excluded from the agreement at the time you list your property for sale.

If it is convenient, it is best to remove any light fixtures or ceiling fans you plan to take with you and replace them before the property is shown to prospective buyers. List all items that are not being sold with the house on your home fact sheet to ensure that they will not become an issue when a buyer makes an offer.
